# AokiApp Normative Application License - Tight

## TERMS AND CONDITIONS

### 1. Definitions

1. "Software" means the implementation, its source code, documentation, examples, and test files.
2. "Private Use" means use of the Software by an individual solely for personal, non-commercial purposes, and not accessible to the public or any third party.
3. "Explicit Written Permission" means a dated document signed by authorized representatives of AokiApp Inc. specifically granting usage rights.
4. "Derivative Works" means any software, documentation, or other materials that incorporate, modify, or are based on the Software.
5. "Open Source Software" means software that is made available to the public under a license that allows users to view, modify, and distribute the source code, as defined by the Open Source Initiative (OSI).
6. "Information Analysis" means the process of extracting information pertaining to the linguistic, audio, visual, and other constituent elements of such information from a large body of works and other substantial information, and performing comparison, classification, and other forms of analysis thereon. (e.g. training AI models, constructing search indexes, etc.)

### 2. Scope of License

This license applies to the software implementation and its associated documentation, examples, test files, and any other materials contained within this repository, except where otherwise noted.

### 3. Source Code Transparency

The source code is made publicly visible for transparency purposes only. This visibility does not grant any rights to use, modify, distribute, implement, or derive from the software in any way.

This software is NOT an open source software, and is not intended for public use or distribution. AokiApp Inc. retains all rights to the software.

### 4. Intellectual Property Rights

This software and its associated protocols, methodologies, and implementations are protected by copyrights, patents, and other intellectual property rights owned by AokiApp Inc. All intellectual property rights, including copyrights, trademarks, trade secrets, and other proprietary rights related to the software are retained by AokiApp Inc.

### 5. Permitted Uses

The following uses are explicitly permitted:

- Viewing and downloading the source code for private use
- Compiling the source code for private use
- Using the software for educational or academic research purposes, provided that:
  - Such use is limited to the minimum extent necessary for the specific research or educational purpose
  - The use does not involve any commercial application or distribution
- Using the source code for information analysis, subject to the following conditions:
  - Such use must not be targeted at replicating this software or reconstructing protected intellectual property
  - Attribution is required when the training dataset is published

### 6. Restrictions

You are explicitly PROHIBITED from:

- Using the software or any part thereof for any purpose beyond private use
- Modifying, adapting, or creating derivative works
- Redistributing, selling, leasing, or transferring the software
- Using any patents, methodologies, or techniques described in or implemented by this software
- Replicating the software in any form, including but not limited to reverse engineering, decompiling, or disassembling

However, the above restrictions do not apply if explicit written permission is granted by AokiApp Inc.

### 8. Patent Notice

### 9. No Implied License

Viewing or accessing the source code does not grant you any licenses or rights to any patents, copyrights, trade secrets, or any other intellectual property.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL AOKIAPP INC. OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

### 11. Hosting Platform Terms of Service

When this software is hosted on any code hosting platform or service provider, certain terms of that platform's Terms of Service may take precedence over portions of this license. This includes, but is not limited to:

- Platform policies regarding acceptable use
- Platform terms related to user-generated content (e.g. Forking, Pull Requests)
- Platform requirements for DMCA and copyright compliance
- Platform policies on licensing and distribution

In cases where a hosting platform's Terms of Service conflict with this license, the platform's terms shall prevail to the minimum extent necessary to comply with their requirements while maintaining maximum possible effect of this license's restrictions.

### 12. Future License Changes

This restrictive license is temporary and may be updated or replaced in the future at the sole discretion of AokiApp Inc. Any such changes will be announced and documented appropriately.

### 13. Termination

This license automatically terminates if you fail to comply with any of its terms. Upon termination, you must immediately cease all use of the Software and destroy all copies in your possession.
